Welcome to MVA Creates (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of https://mvacreates.com (the “Site”) and any purchase you make through the Site. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1) Eligibility & Account Responsibility

By using this Site, you represent that you are at least the age of majority in your state of residence, or you have permission from a parent/guardian to use the Site.

If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activities under your account.

2) Products, Made-to-Order Items & Personalization

Many of our products are made to order and/or personalized. You agree that:

- You are responsible for reviewing all personalization details (spelling, initials, dates, etc.) before submitting your order.

- Product photos and mockups are examples. Natural variations in materials (such as wood grain, color tone, and texture) are normal and may differ from photos.

3) Customer Logos / Artwork Submissions (Email Required)

If your order requires a logo or custom artwork, you must email your file(s) to mvacreates@gmail.com after placing your order.

By submitting a logo/artwork, you represent that you own the rights to it or have permission to use it. You grant MVA Creates a limited license to use your submitted artwork only to create and fulfill your order and to communicate with you about your order. We do not claim ownership of your artwork.

Processing times may be impacted if required artwork is not provided promptly.

4) Pricing, Taxes & Payment

All prices are listed in USD unless otherwise noted and may change without notice. You agree to provide current, complete, and accurate purchase information. We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or violate these Terms.

5) Order Acceptance, Changes & Cancellations

Your order is an offer to purchase. We may accept or decline any order.

Because many items enter production quickly:

- Changes or cancellations must be requested within 4 hours of placing your order.

- After that window—or once production has started—we may be unable to cancel or modify your order.

6) Processing Times, Shipping & Delivery

Processing and shipping estimates shown on the Site or at checkout are estimates and not guarantees.

You are responsible for providing a correct shipping address. If a package is returned due to an incorrect or incomplete address, you may be responsible for additional shipping charges to resend it.

Once a package is handed to the carrier, delivery timing is outside our control.

7) Returns, Exchanges & Refunds

Our Return Policy is incorporated into these Terms by reference. Please review it on our Site (Return Policy page).

In the event of any conflict between these Terms and the Return Policy, the Return Policy will control for returns, refunds, and exchanges.

8) Damaged, Defective, or Incorrect Orders

If your order arrives damaged, defective, or incorrect, please contact us at mvacreates@gmail.com within 48 hours of delivery with your order number and clear photos of the item and packaging (including shipping label if possible).

After review, we may offer a replacement, repair (if applicable), or refund.

9) Prohibited Content & Refusal of Service

You agree not to use the Site or request custom work that is illegal, abusive, harassing, hateful, defamatory, threatening, or that violates any third-party rights (including intellectual property).

We reserve the right to refuse, cancel, or limit orders that violate these Terms.

10) Intellectual Property (Our Content)

All content on the Site—including text, product descriptions, graphics, logos, photos, and designs—is owned by MVA Creates or used with permission and is protected by applicable laws. You may not copy or use Site content without our prior written permission.

11) Reviews, Photos & Testimonials

If you submit a review, testimonial, or customer photo, you grant MVA Creates permission to use it for marketing and promotional purposes (e.g., on our Site or social media), unless you request otherwise in writing.

12) Disclaimer of Warranties

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available.” We do not guarantee the Site will be uninterrupted or error-free.

13) Limitation of Liability

To the fullest extent permitted by law, MVA Creates will not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits).

Our total liability for any claim relating to your purchase will not exceed the amount you paid for the product(s) at issue.

14) Indemnification

You agree to indemnify and hold harmless MVA Creates from any claim, demand, or damages (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights (including intellectual property related to customer-submitted artwork).

15) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

16) Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised “Last updated” date. Continued use of the Site after changes means you accept the updated Terms.
